$1 Felony Case: McDonald's vs Mark Abaire Over a Cup of Soda


As previously reported, 52-year-old Mark Abaire from Naples, Florida is facing up to five years in prison, if convicted of theft, trespass and disorderly intoxication when he allegedly walked out of McDonald's in East Naples last week without paying for a cup of soda.

Abaire was arrested on theft charges after he asked the staff of hamburger store for a cup and filled it up with soda which cost $1 instead of water.

"I take these matters seriously. As a local business owner, I have a responsibility to take appropriate steps to protect my business and keep my customers and employees safe.

"We are fully cooperating with the authorities on this matter. I have an obligation to the public to adhere closely to local and state laws and rely on the counsel of local law enforcement regarding these types of issues. Beyond that, it would be inappropriate to further comment.

"Further inquiries should be directed to the Sherriff's office." Mike Adams, owner of McDonald's store where the incident happened said.

On the other hand, Abaire, who has petty theft and theft convictions in 2007, 2005 and 2003, said he believed McDonald's was in the wrong.

Abaire claimed he wanted water but he was presented with a wide variety of beverages so he chose a drink that was going to cost him a little cash: the $1 soda. Then he went to the table outside to drink the soda but the manager approached him and asked him to pay $1. When he refused to pay, the manager called the police, they tossed him in jail and charged him with $1 felony case.
